HMH does not manufacture, deliver or ship concrete and makes to warranty or representation regarding the concrete to be delivered. HMH is not liable to any customer or any third parties for any damages of any kind that may rise out of relate to the purchase from or delivery of concrete by its affiliates. HMH is a legally distinct entity from its affiliates, HMH’s affiliates are not agents of HMH, and HMH is not a principal of any of its affiliates for purposes of services provided by its affiliates, HMH does not engage in any joint venture with any of its affiliates, HMH and its affiliates are not alter egos of each other, HMH does not have contacts with a particular state by virtue of one or more of its affiliates operating or having a physical location in such state or the operation of this website, HMH is not responsible for the debts or liabilities of its affiliates, and HMH’s affiliates are legally distinct from each other and not responsible for any debts or liabilities of another HMH affiliate. As used throughout this Site and in the website domain, the terms “Hercules,” “the company,” “legal entity,” “the corporation,” “our,” “we” and “us” may refer to HMH or one or more of the affiliates of HMH. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
